MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON NOVEMBER 28, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by Stonemount Developments Inc. (“Appellant”) arising from the failure of the Township of Essa to make a decision on a Zoning By-law Amendment and a Draft Plan of Subdivision (“DPS”) Applications, pursuant to s. 34(11) of the Planning Act, for the property located at 68 Gold Park Gate, Angus (“subject lands”).
2The Appellant is seeking to re-zone the subject lands from "Community Commercial" (C1) Zone to "Residential, Medium Density, Townhome" (R3) Zone with site-specific zoning standards in a “Special Provisions Zone” (R3-X) and “Open Space Park” (OSP) to permit the development of 26 townhomes and four mixed-use dwellings, for a total of 30 dwelling units. The DPS proposes the division of the subject lands into five blocks and a parkette.
3The Tribunal received the Affidavit of Service and marked it as Exhibit 1.
PARTICIPANT STATUS REQUEST
4Prior to the CMC, the Tribunal received two Participant Status requests. Brenda Marshall and Luis Eddy voiced their concerns with the type of the development proposal. Mr. Eddy was not present at the CMC; thus, his request is denied.
5The Tribunal granted Participant Status to Ms. Marshall and will take into account her concerns, as identified in her Participant Statement, when making a decision.
MEDIATION
6The Tribunal reminded the Parties that, should they reach a point where a Tribunal-led mediation will be of assistance, they may request a mediation assessment through the assigned Case Coordinator.
HEARING, PROCEDURAL ORDER AND ISSUES LIST
7Due to the approaching holidays, the Parties requested some additional time to submit the Draft Procedural Order (“DPO”) and Issues List (“IL”) and have requested a five-day Hearing to be scheduled in May.
8The DPO and IL are due on or before Monday, January 5, 2026.
9A five-day Hearing is scheduled to proceed by video and commence on Monday, May 25, 2026, at 10 a.m. and continue through Friday, May 29, 2026.
