MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON JANUARY 28, 2026 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by Post Scriptum Holdings Inc. (“Appellant”) arising from the Town of Oakville (“Town”) Committee of Adjustment denial of a Minor Variance Application, pursuant to ss. 45(12) of the Planning Act, for the property located at 874 Sinclair Road.
2The Appellant is seeking to add a motor vehicle dealership use along with certain related motor vehicle uses.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
4There were no status requests for this CMC.
MEDIATION
5The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
HEARING, PROCEDURAL ORDER, AND ISSUES LIST
6Mr. Perlin stated that the City and the Appellant are having ongoing, without prejudice, discussions regarding a settlement and are trying to reduce the number of issues. At the same time, the City is working on implementing the employment area changes that are relevant to the appeal.
7Mr. Perlin requested additional time to submit a revised Procedural Order (“PO”) and Issues List (“IL”).
8If the settlement discussions do not proceed as planned, the Parties requested a three-day Hearing to be scheduled in April, 2026.
9The PO and IL are due on or before Tuesday, March 3, 2026.
10A three-day Hearing is scheduled to proceed by video on Monday, April 27, 2026 at 10 a.m., continuing to Wednesday, April 29, 2026.
