Order
THESE MATTERS having come before the Tribunal on April 8, 2025;
AND THE TRIBUNAL having been advised by the Town of Coburg that Zoning By-law 066-2025 has been adopted on December 17, 2025, repealing Zoning By-law 85-2003 and all amending By-laws, including By-law 007-2025, which is the subject of this appeal;
AND THE TRIBUNAL having concluded, on a preliminary basis, that the proceeding has no reasonable prospect of success;
AND THE TRIBUNAL having given notice to the Appellants of its intention to dismiss the proceeding, on the Tribunal’s own motion, due to the repeal of By-law 007-2025, and having given the Appellants the opportunity to make written submissions to the Tribunal with respect to the dismissal with fifteen (15) days of the notice, all in accordance with subsection 19(2) of the Ontario Land Tribunal Act;
AND THE TRIBUNAL having received no submissions from the Appellants;
AND UPON motion of the Tribunal for an Order dismissing the Appeals without holding a public hearing under subsection 19(1) of the Ontario Land Tribunal Act,
THE TRIBUNAL ORDERS that the appeals by the Appellants against By-law 007-2025 of the Town of Coburg are dismissed.
