MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON FEBRUARY 3, 2026 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by HOF 2914 Sheppard Ave LP (“Appellant”) arising from the failure of the City of Toronto (“City”) to make a decision regarding the application within the applicable statutory timeline for the Official Plan Amendment (“OPA”) and Zoning By-law Amendment (“ZBA”), pursuant to ss. 22(7) and 34(11) of the Planning Act, for the properties located at 2912-2926 Sheppard Avenue East.
2The Appellant is seeking to permit redevelopment of the subject property to a 50-storey mixed-use building within a Protected Major Transit Station Area.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
PARTICIPANT STATUS REQUEST
4Prior to the CMC, the Tribunal received one Participant Status request from Margareta Cruceanu. Her concerns pertain to loss of sunlight, shadow impacts and traffic. The Tribunal granted Participant Status request to Ms. Cruceanu.
MEDIATION
5The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
6The Parties informed the Tribunal that the mediation assessment would take place on Friday, February 6, 2026.
HEARING, PROCEDURAL ORDER AND ISSUES LIST
7The Parties are hopeful that as a result of the mediation, the number of issues will be reduced and requested some time to submit a draft Procedural Order (“PO”) and Issues List (“IL”).
8The PO and IL are due on or before Monday, February 23, 2026.
9If the mediation discussions do not proceed as planned, the Parties have requested a nine-day Hearing in October of 2026 be scheduled.
10A nine-day Hearing is scheduled to proceed by video on Tuesday, October 20, 2026 at 10 a.m. continuing to Friday, October 30, 2026.
