MEMORANDUM OF ORAL DECISION DELIVERED BY C. I. Molinari ON january 29, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a first Case Management Conference ("CMC") in respect of appeals filed pursuant to s. 34(19) of the Planning Act ("Act") against the approval by the Township of Tiny ("Township") of Township-initiated Zoning By-law ("ZBL") No. 25-039 ("ZBL 039"), being an amendment to the Township’s comprehensive Zoning By-law No. 22-075. ZBL 039 introduced a ‘Shoreline Development Area’, applying to all land within 45 metres ("m") of the 178 m G.S.C. elevation adjacent to Georgian Bay, including ‘Dynamic Beach Hazard’ lands.
NOTICE
2An Affidavit of Service, served on December 3, 2025, attesting to the giving of notice for this proceeding, was marked as Exhibit 1. There were no concerns raised regarding the notice and the Tribunal was satisfied that proper notice of this CMC was provided. In this regard, no further notice is required for the appeals.
PARTIES / PARTICIPANTS
3The Tribunal received the status requests set out below, with no additional requests made during the CMC. The Tribunal also acknowledges the withdrawal of Lauren Hitchman’s appeal on July 17, 2025.
Party Status Requests
4The Tribunal received requests for Party status from the Federation of Tiny Township Shoreline Associations ("FOTTSA") and CBC Country Ltd., Black Marlin Management Ltd., and Calsper Development Inc. ("CBC, Black, and Calsper"), of which both cited concerns related to ZBL 039 and noted active participation in the process. Both FOTTSA and CBC, Black, and Calsper acknowledged the sheltering obligations that apply to a non-appellant party.
5With no objections raised, FOTTSA and CBC, Black, and Calsper were granted Party status as non-appellant Parties pursuant to ss. 34(24.1) and 34(24.2) of the Act, and in accordance with Rule 8.3 of the Tribunal’s Rules of Practice and Procedure requiring non-appellant parties to shelter under an issue raised in an appeal by an appellant party.
Participant Status Requests
6The Tribunal received nine requests for Participant status from Paul Fahey, Therese Hudson-Fahey, Karen Zulynik, Elizabeth Sawyer, Irene Vistoli, Virginia Barber, Caroline Murphy, Kingswood Acres Beach Association, and Cedar Point Cottager’s Association ("CPCA"), each raising concerns related to ZBL 039. As no objections were raised, Participant status was granted to all requestors, with CPCA’s status to be confirmed upon the filing of its Articles of Incorporation with the Tribunal.
7CPCA has since filed sufficient documentation, and its Participant status is accordingly confirmed.
NEXT STEPS
8The Tribunal was not in receipt of a draft Procedural Order or an Issues List ("IL"). After some discussion, the Parties agreed that a second CMC would be required, given that a related Official Plan Amendment ("OPA") was recently approved and appealed. It was further determined that the second CMC should be scheduled to coincide with the first CMC for the OPA appeal, which had not yet been scheduled. It was anticipated that the ZBL appeals would then be consolidated with the OPA appeals. As such, the Tribunal did not schedule a second CMC for the ZBL appeals.
9The Parties determined, and Ms. Hahn undertook, to have a draft IL finalized by Friday, February 27, 2026, for submission to the Tribunal.
UPDATE
10The Tribunal has since administratively consolidated the ZBL and OPA appeals and scheduled a first CMC for the OPA appeals, which will serve as a second CMC for the ZBL appeals, to proceed by video on Tuesday, March 17, 2026, at 10 a.m.

15As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
MEDIATION / SETTLEMENT
16The Tribunal advised the Parties of the options for Tribunal-led mediation, or for a written hearing in the case of a settlement, and to contact the Case Coordinator to determine next steps if the need arises.
ORDER
17THE TRIBUNAL ORDERS THAT:
Party status is conferred on the Federation of Tiny Township Shoreline Associations and CBC Country Ltd., Black Marlin Management Ltd., and Calsper Development Inc. as non-appellant Parties;
Participant status is conferred on Paul Fahey, Therese Hudson-Fahey, Karen Zulynik, Elizabeth Sawyer, Irene Vistoli, Virginia Barber, Caroline Murphy, Kingswood Acres Beach Association, and Cedar Point Cottager’s Association; and
A second Case Management Conference will be held by video hearing as scheduled above.
18No further notice is required.
