THE TRIBUNAL having convened a Case Management Conference (“CMC”) on February 10, 2026 to consider a motion brought by the Crown in Right of Ontario (MTO) (“MTO”) for the adjournment of the hearing of this matter (“Motion”) which had been scheduled to commence on February 17, 2026;
AND THE TRIBUNAL having considered the materials filed by the MTO in respect of the Motion in light of the provisions of Rule 17 of the Tribunal’s Rules of Practice and Procedure, and upon hearing of the consent of the Claimant Paul Roman Wozniak (“Claimant”);
AND THE TRIBUNAL having received submissions from the Parties’ counsel concerning the future scheduling of the hearing of this matter in 2026;
THE TRIBUNAL ORDERS THAT:
The current dates for the hearing of this matter to commence on February 17, 2026 shall be vacated;
Claimant and the MTO shall immediately confer with respect to the scheduling of the hearing of this matter and shall advise the Tribunal accordingly by on or before February 17, 2026;
The Claimant and the MTO shall provide a fresh Procedural Order within 3 days of being advised by the Tribunal of the scheduling of the hearing of this matter; and
This Vice Chair shall remain seized of this proceeding for the purposes of ongoing case management and for all motion practice but shall not be seized in respect of the final hearing of this matter or for any mediation which may be convened.
