THIS MATTER having come before the Ontario Land Tribunal (the “Tribunal”) for a Case Management Conference on November 26, 2025;
AND THE TRIBUNAL having issued the Procedural Order on January 30, 2026, for the purpose of governing the required procedures leading up to the hearing commencing on March 4, 2026;
AND THE TRIBUNAL having received a request, on consent of the Parties, on February 5, 2026, to suspend the remaining procedural deadlines contained in the Procedural Order;
THE TRIBUNAL ORDERS that the following dates from the Procedural Order are suspended:
- Parties to provide their witness statements and expert witness statements (paragraph 13);
- Parties to provide copies of their visual evidence (paragraph 16);
- Parties may provide a written response to any written evidence (paragraph 17);
- Parties to prepare and file a joint document book (paragraph 18);
- Parties to prepare and file a preliminary hearing plan (paragraph 21);
- In all other respects the Procedural Order remains the same.
THE TRIBUNAL FURTHER ORDERS that the Parties provide a written update on the status of this matter to the Case Coordinator by no later than Wednesday, February 11, 2026.
