THIS MATTER having come before the Ontario Land Tribunal (the “Tribunal”) for a written Motion Hearing in respect of the claims of Motek Cultural Initiative (the “Claimant”) as against Metrolinx for compensation pursuant to section 26 of the Act arising from the expropriation of the occupied lands municipally known as 1 Atlantic Avenue in the City of Toronto;

THE TRIBUNAL having been advised, on consent, that a full and final settlement had been reached by the Parties hereto and that the Claimant has agreed to the dismissal of its claims;

THE TRIBUNAL ORDERS that the claims of the Claimant are hereby dismissed on a without costs basis.
