THIS MATTER having come on for a public hearing on October 7-9 and 13-15, 2020 (the “Hearing”), and the Ontario Land Tribunal (the “Tribunal”) by way of a decision issued on September 14, 2021 (the “Decision”), having determined that the appeals under subsections 22(7) and 34(11) of the Planning Act regarding the lands known municipally in the City of Toronto as 5400 Yonge Street and 15 Horsham Avenue (the “Appeals”) should be allowed, in part;
AND THE TRIBUNAL having provided a provisional interim order in paragraph 77 of the Decision but withheld any final order pending the Tribunal being advised that five (5) pre-conditions (the “Pre-Conditions”) have been satisfied;
AND THE TRIBUNAL having been advised that the Pre-Conditions have been addressed to the satisfaction of the City of Toronto;
AND THE TRIBUNAL being satisfied that its direction as set out in the Decision has been met;
THE TRIBUNAL ORDERS that the Appeals are allowed in part, and that the Official Plan for the City of Toronto, as amended, is hereby amended in the manner as set out in Attachment “1” to this Order and that Zoning By-law No. 7625 for the former City of North York, as amended, is hereby amended in the manner as set out in Attachment “2” to this Order. The Tribunal authorizes the municipal clerk to format, as may be necessary, and assign a number to this by-law for record keeping purposes.
