THESE MATTERS in respect of the lands municipally described as 33 Findlay Drive, 22 Campbell Street, 750 Hurontario Street and 774 Hurontario Street (collectively the “Subject Lands”) in the Town of Collingwood, having come before the Ontario Land Tribunal (“Tribunal”) for a Hearing, in writing, on September 5, 2025; and
AND WHEREAS the Tribunal having issued an Order on August 9, 2021 approving a revised Zoning By-law Amendment and adjourning the Site Plan Approval Appeal sine die;
AND WHEREAS these matters were administratively closed by the Tribunal on February 24, 2023;
AND WHEREAS with the consent of all parties, the Applicant/Appellant has requested that these matters be reopened in order for the Tribunal to consider the Site Plan Approval Appeal;
AND THE TRIBUNAL having been advised by the Parties on July 2, 2025, that a full uncontested settlement had been reached between Blackmoor Gates GP and the Town of Collingwood specifically concerning the application for Site Plan Approval and associated conditions to permit 28 single detached dwelling units on a private condominium road, as well as a central community building and visitor parking areas (“Proposed Development”) on the Subject Lands;
AND THE TRIBUNAL having received the uncontroverted evidence of Kory Chisholm of McNaughton Hermsen Britton Clarkson Planning Limited (“MHBC Planning”). The Tribunal hereby accepts and qualifies Mr. Chisolm’s evidence as expert opinion in the area of land use planning for the purposes of this written Hearing;
AND THE TRIBUNAL having reviewed and considered the uncontroverted affidavit evidence of Mr. Chisolm, and having accepted the opinions therein, is satisfied that the Proposed Development as presented:
- has regard to those applicable matters of provincial interest found in s. 2 of the Planning Act;
- is consistent with the Provincial Planning Statement 2024;
- is a Site Plan that is in accordance with s. 41 of the Planning Act;
- conforms to the County of Simcoe Official Plan and the Town of Collingwood Official Plan;
- is in compliance with the Town of Collingwood Zoning By-law 2010-040; and,
- represents good planning in the public interest;
AND THE TRIBUNAL having found that the Proposed Development represents an appropriate form of development on the Subject Lands that features a compatible design that does not create any adverse impacts. And that it: contributes to the provision of a range and mix of additional housing supply in a settlement area, represents an efficient use of municipal infrastructure, including water and sewage services, and supports public transit and active transportation;
NOW THEREFORE
THE TRIBUNAL ORDERS THAT the site plan prepared by MHBC Planning dated March 11, 2020, as revised on March 25, 2025, and set out in Schedule A to this Order is approved;
AND THE TRIBUNAL FURTHER ORDERS that no costs shall be awarded to any party in connection with this proceeding or Order.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
