MEMORANDUM OF ORAL DECISION DELIVERED BY J. Innis ON September 9, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the third Case Management Conference (“CMC”) in respect of appeals brought by 12123045 Canada Inc., et al. under s. 17(36) of the Planning Act, R.S.O. 1990, c. P.13, as amended, regarding the adoption of a new town-wide Official Plan (“OP”) by the Town of Collingwood (“Town”). The OP was adopted by the Town on December 11, 2023, and approved by the County of Simcoe (“County”) on September 24, 2024, with the exception of certain non-decisions identified in the County's notice of decision. The purpose of the new OP is to modernize the Town’s land use planning framework to support sustainable growth over a 20-year horizon.
PROCEDURAL ORDER AND ISSUES LIST
2At the CMC, the Parties reviewed a revised Issues List (attached as Schedule A). Additional issues were added under the appeal of 2204604 Ontario Inc. and sheltering Parties were identified. No Party raised objections to the revisions. The Tribunal notes, however, that, as set out in its earlier Decision dated June 23, 2025, the Issues List remains subject to refinement as technical studies are completed and as efforts are made to continue to scope and consolidate issues. Accordingly, a finalized Procedural Order and Issued List will be issued administratively once submitted to the Tribunal, on consent, no later than Friday, November 7, 2025.
3The Tribunal canvassed the Parties in regard to the proposed phased hearing plan (“proposed plan”) and on consent the Parties agreed that the general approach to the phasing was appropriate, with broader issues to be heard first, followed by site-specific issues. However, several Parties expressed concern that the time allocated to their issues were insufficient. In addition, it was noted and the Tribunal confirmed, that May 4 and 5, 2026 are non-sitting dates of the Tribunal. Certain Parties also indicated that their issues were not reflected in the proposed plan. The Parties agreed to revise the proposed plan collaboratively and to provide a draft to the Tribunal by Tuesday, September 23, 2025 at 12 p.m., along with any proposed additional dates required. A telephone conference call (“TCC”) was scheduled to address this revised plan.
4The Tribunal was advised that resolution efforts had been successful for the appeal by Munro Golf Limited, as well as for the appeals of 2681199 Ontario Inc, 2667588 Ontario Inc., and 2773098 Ontario Inc. (collectively referred to as the “High Street” appeals), and the appeal of DNRN Holdings Inc. Given the number of Parties involved, and the late delivery of materials, the Tribunal determined that it would not be procedurally fair to address the settlement at this CMC. Instead, a separate one-day written settlement hearing was scheduled to consider those matters.
5No further procedural matters were raised requiring the Tribunal's direction at this CMC.

6Upon request of the Parties, the Tribunal scheduled a one-day written settlement hearing to proceed on Wednesday, September 17, 2025. No further Notice is required for the written settlement hearing.
7Further, upon another request of the Parties, the Tribunal scheduled a hearing to proceed by TCC on Wednesday, September 24, 2025, at 9 a.m. No further Notice is required for the TCC.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
