MEMORANDUM OF ORAL DECISION DELIVERED BY ERIC S. CROWE ON SEPTEMBER 11, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) held in preparation for a hearing of the appeal by 1370443 Ontario Ltd., 572989 Ontario Inc., 2038980 Ontario Ltd., 1545 Queensway Inc.(“Appellants”) pursuant to s. 22 (7), Official Plan Amendment (“OPA”) of the Planning Act of the City of Toronto (“City”). The municipal addresses of the Subject Site is 1549-1551 The Queensway and 66 & 76 Fordhouse Boulevard (Subject Site”).
BACKGROUND
2The Appellant’s application is to redesignate and rezone the subject site from General Employment Areas and Core Employment Areas to Mixed Use Areas for development of four tall buildings (30,35,40,45 Storeys).
3The proposed application was appealed to the Ontario Land Tribunal (“OLT”) for failure of the City to make a decision within the statutory time frames on the applications in accordance with the requirements of the Planning Act (“Act”).
4The purpose of this CMC was to consider requests for Party or Participant status and request a second CMC. The Parties advised the City does not yet have instructions; a second CMC would enable the City the opportunity to seek instructions at the November Council meeting scheduled for November 12 to 14, 2025.
5There was one Participant status request from Wolfecorp Queensway Inc. (“Wolfecorp”). Wolfecorp is the owner of lands (1425 The Queensway) which are located east of the subject site. The owner, being a nearby neighbour, requests to ensure that any approved development on the subject site does not adversely impact the current use of the owner’s lands or the owner’s ability to redevelop its lands in the future. However, currently the owner is not opposed to the development proposal and this request for Participant Status is made to monitor the proceedings.
6The Tribunal, having considered its submissions with no objections from the Parties for this request, granted Participant status to Wolfecorp.

8The Parties were encouraged to request, through the Case Coordinator, Tribunal-facilitated mediation to assist with settlement discussions should the parties deem it potentially helpful in this regard.

9Based on the request of the Parties, the Tribunal has found it is reasonable to schedule a second CMC to occur by video on Wednesday, February 25, 2026, at 10 a.m.

ORDER
14THE TRIBUNAL ORDERS THAT:
- Participant Status is granted to Wolfecorp Queensway Inc.
- A subsequent CMC is scheduled for Wednesday, February 25, 2026, at 10 a.m. by video.
- The Tribunal Member is not seized but may be spoken to in the event matters arise.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
