THE TRIBUNAL having issued the Procedural Order on July 31, 2025, for the purpose of governing the required procedures leading up to the 10-day hearing originally commencing on September 26, 2025, which was reduced on consent of the Parties to six days commencing on October 2, 2025 then continuing from October 6 – 10, 2025, not sitting on October 3, 2025;
AND THE TRIBUNAL having issued an amended Procedural Order on August 15, 2025 at the request of the Parties to amend various procedural deadlines in the Procedural Order;
AND THE TRIBUNAL having issued a further amended Procedural Order on August 26, 2025 to further amend various procedural deadlines in the Procedural Order;
AND THE TRIBUNAL having received a request, on consent of the Parties, to further amend some of the procedural timelines contained in the Procedural Order;
THE TRIBUNAL ORDERS that the following dates from the Procedural Order are amended:
Parties to exchange witness statements and expert witness statements (paragraph 13) changed from September 2, 2025, to September 9, 2025;
Parties to exchange reply witness statements and expert witness statements (paragraph 15) changed from September 12, 2025, to September 16, 2025;
Parties to exchange visual evidence and joint document book (paragraph 16) changed from September 16, 2025, to September 23, 2025;
Parties shall provide a draft hearing plan (paragraph 17) changed from September 19, 2025, to September 26, 2025.
