MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON SEPTEMBER 3, 2025 AND ORDER OF THE TRIBUNAL
1This is the first Case Management Conference (“CMC”) for the above-noted matter. 1000009801 Ontario Inc. & Tonlu Holdings Limited (“Appellants”) filed an appeal against the City of Toronto’s (“City”) failure to make a decision within the statutory time frame for the Appellant’s application to permit a mixed-use development of six buildings, ranging in height from 12 to 42 storeys, with respect to the properties 350, 360, and 364 Evans Avenue, and 14–16 Arnold Street, in the City. The appeal was brought pursuant to s. 22(7) of the Planning Act.

3There was no party or participant status request received.
DRAFT PROCEDURAL ORDER
4Counsel informed the Tribunal that City Council will meet around November 13, 2025, and instructions on the Issues will follow thereafter. Parties could then prepare the draft Procedural Order (“PO”) and Issues List (“IL”).
5Mr. Platt requested a second CMC be scheduled in the latter part of November, 2025.
MEDIATION
6Currently, the Parties have no instructions on mediation.
DISPOSITION
7The Tribunal will schedule a second CMC as the PO and IL are not available. There will be no further notice, and the Member is not seized.
8The Tribunal directs that the PO, with the IL, be forwarded to the Case Coordinator by Wednesday, November 19, 2025.

9The second CMC is scheduled to proceed by video on Wednesday, November 26, 2025 at 10 a.m.
