THESE MATTERS having come before the Ontario Land Tribunal (“Tribunal”) for a Case Management Conference on March 7, 2025;
AND THE TRIBUNAL having issued a Procedural Order on March 31, 2025 for the purpose of governing the required procedures leading up to the hearing originally scheduled to commence on November 3, 2025;
AND THE TRIBUNAL having received requests, on consent of the Parties, to amend some of the procedural timelines contained in the Procedural Order and having issued Orders amending the Procedural Order dated July 24, 2025 and August 14, 2025;
AND THE TRIBUNAL having received a request, on consent of the Parties, to further amend the procedural timelines and the hearing commencement date contained in the Procedural Order;
THE TRIBUNAL ORDERS that the Procedural Order is revised as follows:
- Deadline to file Statement of Agreed Facts and Issues from August 29, 2025 to October 14, 2025;
- Parties to exchange their Witness and Expert Witness Statements and Participants to provide their Participant Statements from September 18, 2025 to October 15, 2025;
- Parties to confirm if all the reserved hearing dates are still required from September 24, 2025 to October 17, 2025;
- Parties to exchange their Reply Witness Statements from October 8, 2025 to October 31, 2025;
- Parties to exchange their Visual Evidence from October 14, 2025 to November 5, 2025;
- Parties to File Joint Document Book and the Preliminary Hearing Plan from October 24, 2025 to November 10, 2025.
AND THE TRIBUNAL ORDERS the 6-day merit hearing will now commence on November 19, 2025 at 10 a.m. through the following video link:
