THIS MATTER having come before the Ontario Land Tribunal (the “Tribunal”) for a Case Management Conference on May 5, 2023 in respect of the claims of Big Wax Inc. (the “Claimant”) as against Metrolinx for compensation pursuant to section 26 of the Act arising from the expropriation of the lands municipally known as 271 Front Street in the City of Toronto;
THE TRIBUNAL having been advised, on consent, that a full and final settlement had been reached by the Parties hereto and that the Claimant has agreed to the dismissal of its claims;
THE TRIBUNAL ORDERS that the claims of the Claimant are hereby dismissed on a without costs basis.
