MEMORANDUM OF ORAL DECISION DELIVERED BY ERIC S. CROWE ON AUGUST 8, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) held in preparation for a hearing of the appeals by Rowhedge Construction Ltd. (“Appellant”) pursuant to s. 22 (7), Official Plan Amendment (“OPA”) and s. 34(11) Zoning By-law Amendment (“ZBL”) both from the Planning Act of the Town of Oakville (“Town”). The municipal address of the Subject Property is 15 Loyalist Trail in the Town (“Subject Property”).
BACKGROUND
2The Appellant’s applications are to redesignate and rezone the subject property from employment to residential to permit the development of 40 stacked townhouses.
3The Town Planning Staff recommended refusal of the applications and the Town Council followed this recommendation in refusing the applications on the basis that the proposed development was premature and the Appellant did not adequately demonstrate that the subject property is not needed or viable for service area employment uses as reflected in the current designation and zoning to support the change in land use to residential.
4The purpose of this CMC was to consider requests for Party or Participant status and request a Procedural Order and set hearing dates.
5There were no Participant or Party Status requests.

7The Parties were encouraged to request, through the Case Coordinator, Tribunal-facilitated mediation to assist with settlement discussions should the parties deem it potentially helpful in this regard.
PROCEDURAL ORDER AND ISSUES LIST
8The Tribunal was in receipt of a draft Procedural Order and Issues List and requests that the Parties work together and file a final Procedural Order and Issues List with the Tribunal on or before Friday, August 15, 2025.
SCHEDULING OF HEARING
9Based on the request of the Parties, the Tribunal has found it is reasonable to schedule a nine-day Merit Hearing to occur by video on Tuesday, June 16, 2026 to Friday June 26, 2026, at 10 a.m.

ORDER
14THE TRIBUNAL ORDERS a Merit Hearing has been scheduled for Tuesday, June 16, 2026 to Friday, June 26, 2026 at 10 a.m. by video.
15THE TRIBUNAL ORDERS that the Parties file a draft Procedural Order with the Tribunal on or before Friday, August 15, 2025.
16AND THE TRIBUNAL FURTHER ORDERS that the Tribunal Member is not seized but may be spoken to in the event matters arise.
