MEMORANDUM OF ORAL DECISION DELIVERED BY Kurtis Smith ON July 24, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened the second Case Management Conference (“CMC”) pertaining to the appeals filed against the City of Toronto (“City”) initiated Official Plan Amendment (“OPA 778”) pertaining to the Avenues Policy Framework within the City.
2Prior to the commencement of the second CMC the Tribunal was in receipt of correspondence from 2441952 Ontario Inc. stating that they have withdrawn their appeal and that 430 Royal York GP Inc. have withdrawn their Party status following the issuance of the Tribunal’s decision on their motion.
PARTICIPANT STATUS REQUEST
3Following the second CMC the Participant status request from the Swansea Area Ratepayers Association and Group (“SARA/SARG”) was circulated to all Parties as the request was not provided to all Parties in advance of the first CMC.
4Without objection, the Tribunal granted Participant status to SARA/SARG as they have a direct interest in OPA 778 as it relates to the lands within their association/group’s area.
SCOPING OF APPEALS AND DEEMING OPA 778 INTO FORCE AND EFFECT
5As directed by the Tribunal, the Parties geographically scoped their appeals and distinguished which appeals are Site-Specific and which are City-Wide appeals as provided and outlined in Attachment 1 to this Order.
6The City then requested that the unappealed portions of OPA 778 be confirmed to have come into force and effect on March 14, 2025, by operation of s. 17(27) of the Planning Act. The Appellants consented to the request, and as such, the Tribunal confirmed that the unappealed portions of OPA 778 came into force and effect on March 14, 2025.
NEXT STEPS
7The Tribunal scheduled a third CMC for Monday, September 29, 2025. In advance of the CMC, the Appellant will provide the City with their Issues List (“IL”) on or before Wednesday, September 10, 2025, and the City will then incorporate the IL into the draft Procedural Order, which will be provided to the Tribunal by Friday, September 19, 2025. Additionally, the City and Appellants indicated that they will continue positive dialogue to reduce and scope their appeals.
8The third CMC is scheduled to proceed by video on Monday, September 29, 2025 at 10 a.m.

ORDER
13THE TRIBUNAL ORDERS that:
a. Swansea Area Ratepayers Association and Group is granted Participant status;
b. a third Case Management Conference is scheduled as set out above;
c. the Appellants will provide their Issues List to the City on or before Wednesday, September 10, 2025;
d. the City will provide the draft Procedural Order and Issues List to the Tribunal on or before Friday, September 19, 2025;
e. OPA 778 came into force and effect on March 14, 2025 by operation of s. 17(27) of the Planning Act, save and except the outstanding appeals in Attachment 1 to this Order, which are scoped geographically to the listed addresses and areas identified in Column 3 (Geographic Scoping of Appeals) with respect to the portions of OPA 778 identified in Column 4 (Portions of OPA 778 under Site-Specific Appeal), and the portions of OPA 778 identified in Column 5 (Portions of OPA 778 under Appeal City-Wide); and
f. the Member is not seized, but may be contacted through the Case Coordinator should procedural issues arise.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
