MEMORANDUM OF ORAL DECISION DELIVERED BY W. DANIEL BEST ON JULY 23, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the second Case Management Conference (“CMC”) for appeals to Development Charges By-law 24-35 passed by the Town of Erin (“Town”) on July 18, 2024.
UPDATE
2The Town updated the Tribunal that the Parties met to attempt to scope the Issues List (“IL”) and finalize the draft Procedural Order (“PO”).
3The Town advised the Tribunal that the draft PO and IL could be forwarded to the Case Coordinator post-CMC for the consideration of the Tribunal.
NEXT STEPS
4The Tribunal directed the Town to submit a draft PO on consent on Wednesday, July 23, 2025. The Tribunal will review the draft PO and if approved, it will govern the proceedings of the hearing.
5The Tribunal inquired as to whether there were any other matters to be addressed which might assist in the fair, just, and expeditious resolution of this matter. The Parties indicated there were none.
6The Tribunal thanked Counsel for the Parties for their assistance.
7Having the benefit of receiving the submitted revised draft PO from the Town prior to the issuance of this Decision, and having examined the IL attached to the PO, the Tribunal deems the attached PO to be in of force and effect to govern the proceedings. The Tribunal directs that the Hearing of the Merits is scheduled to begin on Monday, December 1, 2025 at 10 a.m. by Video Hearing. Any changes to the PO will require the approval of the Tribunal.
