MEMORANDUM OF ORAL DECISION DELIVERED BY W. DANIEL BEST ON JULY 24, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from the first Case Management Conference (“CMC”) for the above-noted matter. The Appellant filed an appeal against the Town’s Development Charges By-law No. 13-2025 (“DCBL”) under s. 14 of the Development Charges Act, 1997, S.O. 1997, c. 27(“DCA”).
2There are two Parties of record in this matter. No additional requests for party status were made at this CMC. There were no requests for participant status.
3The Tribunal served notice on June 2, 2025. There is no further notice required.
4Mr. Biggart, counsel for the Town, provided background and a status update for the benefit of the Tribunal.
5Mr. Harrington, counsel for the Appellant, has only recently been retained.
6Counsel agreed that, prior to the next CMC, a Procedural Order (“PO”) and scoped Issues List (“IL”) will be submitted to the Tribunal in advance.
7The Parties were canvassed to determine if there is a benefit for Tribunal-led mediation to assist in this matter. The Tribunal was advised that there have been preliminary discussions, which will continue, but Parties do not see the benefit of mediation at this time.
NEXT STEPS
8On consent, counsel agreed that the Appellant will submit a draft PO and IL to the Town by Monday, August 25, 2025. This will allow the Parties to finalize the draft PO and IL and submit them to the Tribunal in advance of the next CMC.
9The Tribunal directed the Parties to come to the next hearing prepared to schedule a merit hearing. Preparation to schedule includes the PO and scoped IL, identifying potential dates, hearing length, and number of witnesses.
10The Tribunal inquired as to whether there were any other matters to be addressed which might assist in the fair, just, and expeditious resolution of this matter. The Parties indicated there were none.
11A second CMC is scheduled to proceed by video on Wednesday, October 1, 2025, at 10 a.m.
