MEMORANDUM OF ORAL DECISION DELIVERED BY A. MASON ON JULY 9, 2025, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This first Case Management Conference (“CMC”) was held with respect to appeals of the Town of Milton (“Town”) Official Plan Amendment No. 86 (“OPA 86”) pursuant to s. 17(24) of the Planning Act, R. S. O. 1990, c. PO.13, as amended (“Act”), and Zoning By-Law Amendment No. 036-2025 (“ZBLA 036-2025”) pursuant to s. 34(19) of the Act.
2Bill 97, Helping Homebuyers, Protecting Tenant’s Act, made various changes to the Act including a new definition of “Area of Employment” and revised criteria for removal of lands from employment areas.
3OPA 86 addresses changes to the Act arising from Bill 97 and policies in the Provincial Planning Statement, 2024 as they relate to “Areas of Employment” and conversion policy within the Town’s Official Plan (“OP”). OPA 86 is intended to bring the OP into conformity and is implemented by ZBLA 036-2025.
4On March 17, 2025, the Town approved OPA 86 and ZBLA 036-2025.
5Each of the Parties have active or potential developments in the Town. FCHT Holdings (Ontario) Corporation is the only Party that filed appeals of both OPA 86 and ZBLA 036-2025.

6An Affidavit of Service sworn on May 21, 2025 attesting to the provision of Notice in accordance with the Act was marked as Exhibit 1.
OPPORTUNITIES FOR SETTLEMENT
7The Parties advised the Tribunal that they are each in active and constructive discussions with the Town and expect to continue with an objective of full resolution.
SECOND CMC AND DETAILS
8The Parties requested that a second CMC be scheduled in order to continue settlement discussions. The Tribunal scheduled a second CMC for Tuesday, October 21, 2025 at 10am, by video conference.
