INTRODUCTION
1The City of Toronto (“City”) initiated Official Plan Amendment No. 788 (“OPA 788”) for the purpose of amending Site and Area Specific Policy 400 (“SASP 400”) with respect to the lands municipally known as 1871, 1875, 1880, 1885, and 1888 O'Connor Drive, and 1460, 1468 and 1474 Victoria Park Avenue to implement the preferred alignment for the O’Connor Drive Reconfiguration.
2BRL Realty Limited (“Appellant”) is the lone appellant in this matter and is the owner of 1474 Victoria Park Avenue (“Subject Lands”). The Appellant takes the position that the Subject Lands represent a prime opportunity for significant intensification and OPA 788 restricts new development to mid-rise buildings.
3It is noted that the Subject Lands are part of Case No. OLT-22-002510, regarding the Golden Mile Secondary Plan (“GMSP”) as GMSP and SASP 400 overlap the Subject Lands. Mr. Andres advised the Tribunal that there is a “possibility” to request to have these matters heard together or consolidated in the future.
4No Party or Participant Status requests were received.
5The Tribunal marked the Affidavit of Service of the Case Management Conference (“CMC”) as Exhibit 1. There were no issues with the notice, and as such, no further notice is required.
SCHEDULED SECOND CMC
6The Parties’ requested a second CMC be scheduled for December 2025, to provide ample time to meet, discuss, and possibly resolve the matter. The Parties’ intended to meet in September of 2025, pending the outcome the meeting, the City will have sufficient time to seek direction from City Council to scope or resolve the appeal.
7The Tribunal scheduled the Second CMC to commence at 10 a.m., on, Wednesday, December 10, 2025, by Video Hearing, and directed that the Parties provide and update to the Case Coordinator on or before Monday, December 1, 2025.
