UPON APPEAL having been brought by Graywood CM GP Inc. (“Appellant”) under section 22(7) and 34(11) of the Planning Act, regarding a decision by the City of Toronto (“City”) to refuse applications which would facilitate the construction of a 48-storey mixed use development at the properties municipally known as 506-516 Church Street in the City (“Subject Properties”).
AND THE TRIBUNAL having marked as Exhibit 1 the Affidavit of Service attesting to proper Notice having been given for this Case Management Conference (“CMC”) and proceeded to conduct a CMC on June 18, 2025, held by videoconference;
AND THE TRIBUNAL having heard submissions from the Appellant requesting that a ten-day hearing be scheduled in early 2026, that they anticipated having two or three expert witnesses, that they had no objections to the party and participant status requests, requested that the Tribunal set a date for the submission of a final Draft Procedural Order in the near future. The other Parties consent to these submissions.
AND THE TRIBUNAL having heard that the City did not add heritage issues at this time as they are satisfied with the proposed massing around the heritage buildings and indicated that should any changes to the proposal resulting in concerns related to heritage, they reserve the right to update their issues.
AND THE TRIBUNAL granted Party Status to OEF Village Green Nominee Inc. who owns property near the proposed development and identified several planning related issues which may impact the existing and future redevelopment of their property. The Church Wellesley Neighbourhood Association were also granted Party status given their ongoing involvement with planning related matters for this area and commit to fully participate in the proceedings. The Appellant and the City did not object to these Parties being granted status.
AND THE TRIBUNAL granted Participant status to the Metropolitan Toronto Condominium Corporation No. 1329 given their proximity to the Subject Properties and concern for the potential impacts related to sunlight, privacy, construction disruptions and overall impact on community character. The representative was directed to follow the dates of the Procedural Order related to Participant submissions to the Tribunal. The Parties, on consent, supported the approval of Participant status for this group.
AND THE TRIBUNAL confirmed the Parties’ awareness of Tribunal-led mediation;
AND THE TRIBUNAL at the CMC set a 9-day hearing to commence on Monday, March 23, 2026 at 10 a.m. and concluding on Thursday, April 2, 2026, by videoconference. The Parties will submit a Draft Procedural Order to the Tribunal by Friday, July 25, 2025.
