UPON APPEAL having been brought by John Reid under subsection 45(18) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, against the decision of the City of London Committee of Adjustment to deny minor variances, which seek to permit an additional residential unit located on the lands municipally known as 869 Waterloo Street, in the City of London;
AND THIS MATTER having come before the Tribunal on Tuesday, June 24, 2025, by Written Hearing;
AND THE TRIBUNAL having reviewed the written submissions of the Appellant and the affidavit of Catherine Maton sworn June 23, 2025, relating to the application for minor variances to permit an additional residential unit in an accessory building on lands known as 869 Waterloo Street in the City of London.
THE TRIBUNAL ORDERS:
That relating to the approval of minor variances pertaining to lands known as 869 Waterloo Street in the City of London and in accordance with subsection 45(18) of the Planning Act, R.S.O. 1990, c. P.13 the appeal is allowed, and the minor variances as stated in Application A-25014 to the City of London Zoning By-law No. Z-1 are authorized, subject to the conditions set out in the Planning Report prepared by Mr. Queenan and approved and recommended by Ms. Maton that:
a. At the time of Building Permit submissions, Mr. Reid provide elevations to ensure there are no encroachments into the City lane; and
b. The downspouts on the north/south side of the residence are relocated to discharge onto greenspace in the front yard and rear yard or an LID with a drawing submitted to the city with the proposed downspout locations ensuring lot drainage isn’t affected for neighbouring properties, and they are not accepting additional stormwater flows.
