MEMORANDUM OF ORAL DECISION DELIVERED BY A. SAUVE ON MAY 27, 2025, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the second Case Management Conference (“CMC”) for this matter. The City had failed to make a decision regarding these Applications requesting an Official Plan Amendment and a Zoning By-law Amendment regarding 126, 136 and 140 Bradford Street (“Subject Lands”) within the specified time period.
2The Appellant filed the Applications to facilitate the development of the Subject Lands with a mixed-use building, composed of two residential towers, each 45 storeys in height, connected by a shared six-storey podium with commercial uses at grade. The Subject Lands have an approximate area of 0.39 hectares with 89.9 metres (“m”) of frontage along Bradford Street, and are located approximately 360 m east of the shoreline of Lake Simcoe.
3The Parties submitted a draft Procedural Order (“PO”); however, the Issues List had not been completed as the Parties were still undergoing discussions. The draft PO was not yet available at the date of issuance of this Decision. The Parties will have until Monday June 30, 2025, to complete and draft PO and submit it to the Tribunal.
4The Tribunal received a Participant status request prior to this CMC for Mr. Gary Bell. Mr. Bell is a neighbour and meets the relevant criteria to be a Participant. With no objection from the Parties, the Tribunal granted Mr. Bell Participant status.
5The Parties wished to schedule a Merit Hearing, but informed the Tribunal that if issues are resolved prior to the Hearing, they will inform the Tribunal Hearing dates can be released.
6The Tribunal directs that a 10-day Merit Hearing will be scheduled from Monday, May 25, 2026, to Friday June 5, 2026, at 10 a.m. by Video.
7Parties are asked to log into the video hearing at least 15 minutes before the start of the event to test their video and audio connections.
