UPON APPEALS having been brought by Glen Rouge Developments Inc. (“Appellant”) under subsection 22(7) and 34(11) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, regarding the failure by the City of Brampton (“City”) to make decisions within the prescribed time period in respect of applications for an Official Plan Amendment and a Zoning By-law Amendment, respectively, which seek to facilitate the development of a mixed-use development comprised of three high-rise buildings consisting of commercial, medial office, and apartment units as well as stacked townhouse dwellings totaling 1240 residential units on the lands municipally known as 2036 Bovaird Drive, in the City of Brampton (“Subject Lands”);
AND THIS MATTER having come before the Tribunal on Thursday, June 12, 2025, by videoconference for a first Case Management Conference (“CMC”), whereby it marked as Exhibit 1 the Affidavit of Service of Darlene Hornsby sworn on May 15, 2025, attesting to proper Notice having been given for this first CMC;
AND THE TRIBUNAL, having received one request for Participant status from Mount Pleasant Heights Block 51-3 Landowners Group Inc., the trustee appointed for the purposes of the Block 51-3 Cost Sharing Agreement dated April 21, 2025, governing the Block 51-3 Plan area, thereby having a direct interest in the proceedings;
AND THE TRIBUNAL, having considered the submissions made on behalf of the proposed Participant, there being no objections made by either of the Statutory Parties, found that there are reasonable grounds for the request and thereby granted Participant status to the Mount Pleasant Heights Block 51-3 Landowners Group Inc.;
AND THE TRIBUNAL having been informed that the City has been unable to circulate its draft Issues List (“IL”) as it awaits formal instructions from its Council following its next City Council Meeting, which meeting is set to take place on Wednesday, June 25, 2025;
AND THE TRIBUNAL having been informed by the Parties that despite not having circulated a working IL, they were in agreement that ten-days would be sufficient for a Hearing on the Merits with approximately 5-6 witnesses combined on two key areas being planning and market evidence, of which estimated dates could later be reduced and released from the Tribunal calendar should they be found to no longer be necessary;
AND THE TRIBUNAL having determined that the City Council meeting of Wednesday, June 25,2025, would not prejudice the Applicant in obtaining equivalently speedy Hearing dates at a second CMC that could be scheduled within the next month;
AND THE TRIBUNAL having determined that it will not set Hearing dates until it receives a final drat Procedural Order (“PO”) inclusive of finalized IL from the Parties;
AND THE TRIBUNAL having directed that a final PO, inclusive of a final IL is due to be filed no later than Wednesday, July 9, 2025;
AND THE TRIBUNAL having scheduled a second CMC, for the purpose of confirming the appropriate Hearing length and dates once the finalized PO has been filed, the second CMC having been scheduled to be held on Monday, July 14, 2025, at 10 a.m. by videoconference with the following log-in credentials:

AND THE TRIBUNAL having encouraged the Parties to avail themselves of Tribunal-led mediation in order to assist in resolving or narrowing the issues in dispute;
THE TRIBUNAL ORDERS THAT:
Participant Status be and is hereby granted to Mount Pleasant Heights Block 51-3 Landowners Group Inc.
A final Procedural Order inclusive of finalized Issues List be filed by no later than Wednesday, July 9, 2025.
A second Case Management Conference is scheduled to be held on Monday, July 14, 2025 at 10 a.m., by videoconference at the details above referenced.
