MEMORANDUM OF ORAL DECISION DELIVERED BY HUGH S. WILKINS ON MAY 9, 2025 AND ORDER OF THE TRIBUNAL
1On May 9, 2025, the Tribunal held a Case Management Conference (“CMC”) regarding a zoning by-law amendment appeal brought by Halls-Lake Ridge Limited Partnership (“Appellant”) in relation to the property located at 1650 Halls Road North in the Town of Whitby.
2At a CMC held on August 15, 2024, the Tribunal approved a Procedural Order (attached to the Tribunal’s Order and Decision, dated September 27, 2024) governing this proceeding and scheduled a six-day hearing commencing on November 1, 2024.
3Subsequent to the August 2024 CMC, the Parties engaged in settlement discussions. They requested that the hearing be adjourned, which was approved by the Tribunal on October 30, 2024. On February 7, 2025, the Parties informed the Tribunal that they were unable to reach a settlement and they requested a further CMC at which new hearing dates could be scheduled.
4The Tribunal held a further CMC on May 9, 2025 at which the Parties expressed an openness to continuing settlement discussions, but requested that an eight-day hearing be scheduled. The Tribunal scheduled new hearing dates to commence at 10 a.m. on Wednesday, October 29, 2025 by video hearing. Eight days have been set aside for the hearing.

9At the CMC on May 9, 2025, the Parties informed the Tribunal that each of the requirements in the Tribunal’s Procedural Order, attached to the Tribunal’s Order and Decision, dated September 27, 2024, has been satisfied, except for the requirement that a Hearing Plan be filed with the Tribunal no later than seven days before the commencement of the hearing. The Tribunal directed that paragraph 22 of the Procedural Order is amended by inserting the new due date of October 22, 2025 for the filing of a Hearing Plan.
10The Tribunal also requests that, by no later than Wednesday, September 24, 2025, the Parties shall confirm with the Tribunal if all the reserved hearing dates are still required.
ORDER
11The Tribunal orders THAT an eight-day hearing is scheduled to commence on Wednesday, October 29, 2025 at 10 a.m. by video hearing.
12The Tribunal FURTHER orders THAT paragraph 22 of the Procedural Order for this proceeding, attached to the Tribunal’s Order and Decision, dated September 27, 2024, is amended by inserting the new due date of October 22, 2025 for the filing of a Hearing Plan.
