UPON APPEAL to the Ontario Land Tribunal (“Tribunal”), and the Tribunal on its own motion pursuant to subsection 34(31) of the Planning Act, to make an order providing that any part of the by-law not at issue in the appeal shall be deemed to have come into force on the day the by-law was passed;
THE TRIBUNAL ORDERS that By-law 2025-052 of the Municipality of Kincardine save and except for the portions/provisions of said by-law being the appealed portions filed by BEC Business Innovation Centre Inc. site specific to the property known legally as Bruce Concession 3 Part Lots C, D and E; RP 3R3851 Parts 2 and 3 (Roll Number 4108-260-001-12201 PIN 33286-0193), shall be deemed to have come into force on April 23, 2025.
