UPON APPEAL having been brought by 2085308 Ontario Limited et al., under subsection 17 (36) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, regarding the adoption of Official Plan Amendment No. 95 for the Glendale Secondary Plan by the Town of Niagara-on-the-Lake;
AND THIS MATTER having come before the Tribunal on Friday, June 6, 2025, by videoconference for a first Case Management Conference (“CMC”), whereby it marked as Exhibit 1 the Affidavit of Service of Grant Bivol, dated April 25, 2025, attesting to proper Notice having been given for this first CMC;
AND THE TRIBUNAL, having received two requests for Party status from White Oaks Tennis World Inc. and 1526882 Ontario Inc. (jointly as one party) and Julie Smith (collectively the “Proposed Non-Appellant Parties”);
AND THE TRIBUNAL, having considered the submissions made by the Proposed Non-Appellant Parties, as well as the Statutory Parties, granted Non-Appellant Party status to White Oaks Tennis World Inc. and 1526882 Ontario Inc, jointly as one Party. The Tribunal deferred consideration of the Party status request submitted by Ms. Smith to the next CMC. While Ms. Smith was not in attendance, her written request indicated that the short notice made participation in this event impractical. In the interest of procedural fairness, the Tribunal determined that her request will be addressed at the next scheduled CMC.
AND THE TRIBUNAL confirmed the Parties’ awareness of Tribunal-led mediation;
AND THE TRIBUNAL at the CMC having scheduled a second CMC to commence on Friday, September 19, 2025 at 10 a.m. by videoconference; with the following log-in credentials:

AND THE TRIBUNAL, directing that the Parties shall file with the Tribunal by Monday, September 15, 2025, a copy of the draft Procedural Order along with finalized Issues Lists which shall include identification of which issues each of the Proposed Non-Appellant Parties will be seeking to shelter under in regard to their respective requests for Party status for consideration at the second CMC;
THE TRIBUNAL ORDERS THAT:
Non-Appellant Party status be and is hereby granted jointly as one Party to White Oaks Tennis World Inc. and 1526882 Ontario Inc.
The Parties shall file a Procedural Order, inclusive of Issues List which shall include identification of which issues each of the Proposed Non-Appellant Parties will be seeking to shelter under this regard to their respective requests for Party status, with the Tribunal no later than Monday, September 15, 2025.
A second CMC is scheduled to commence on Friday, September 19, 2025 at 10 a.m., by videoconference at the details above referenced to consider the scheduling of any necessary motions (if required), to canvas the viability of participation in Tribunal-led mediation, and any other procedural matters that may arise with the goal of organizing these appeals for a hearing on their merits.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
