MEMORANDUM OF ORAL DECISION DELIVERED BY S. BRAUN ON JUNE 10, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) held for the purpose of organizing appeals by 2631622 Ontario Corp. (“Appellant”) against the failure of the City of Vaughan (“City”) to make a decision on an application for an Official Plan Amendment (“OPA”) and temporary Zoning By-law Amendment (“ZBA”) in relation to the property located at 11151 Highway 50 (“Subject Property”). This was also the first CMC for an appeal against the City’s adoption of By-law No. 174-2024.
2The Tribunal received a sworn Affidavit from Andrea Buchanan, dated April 30, 2025, confirming that Notice of the CMCs in the above noted matters was properly given, and as such, no further Notice is necessary.
3No written requests for status were received, nor did any individuals attend the CMC seeking status in any of the aforementioned appeals. Accordingly, the appeals will proceed with the involvement and participation of only the City and the Appellant.
4Pursuant to Rule 16.1 of the Tribunal’s Rules of Practice and Procedure, which empowers the Tribunal to order two or more proceedings, or any part of them, consolidated, heard at the same time, or heard one after the other, the Parties requested the Tribunal order the appeals be heard together. The Tribunal was advised that By-law No. 174-2024 is a site-specific by-law and that there are no other appeals thereof. The Tribunal granted the request and ordered the appeal of By-law No. 174-2024 (Case No.: OLT-25-00061) be heard together with the appeals of the OPA and ZBA (Case Nos.: OLT-25-000064 and OLT-25-000063).
5The Parties advised that they are currently engaged in discussions aimed at resolving some/all of the issues. As such, they requested the scheduling of a second CMC, which will be held by video hearing, commencing at 10:00 a.m. on Wednesday, October 22, 2025. The Parties were directed to submit a draft procedural order and issues list on consent no later than Wednesday, October 15, 2025. Should the Parties’ settlement discussions be successful, they may email the assigned Case Coordinator to request conversion of the CMC to a written or video hearing for the Tribunal to consider same.
