THESE MATTERS, in respect of the lands at 3450 Dufferin Street (the “Subject Property”), having been heard at a public hearing in June 2019, and the Local Planning Appeal Tribunal, now continued as the Ontario Land Tribunal (the “Tribunal”), having issued its interim decision and order on November 15, 2019 (the “Decision”) granting the site-specific appeals in part and approving the official plan amendment to the City of Toronto (the “City”) official plan, zoning by-law amendment to City zoning by-law 569-2013 (the “ZBA”) in principle and approving a draft plan of subdivision (the “Draft Plan of Subdivision”) with respect to the Subject Property;
AND THE TRIBUNAL having issued its final order on April 22, 2020 (the “Final Order”) approving the ZBA and the Draft Plan of Subdivision conditions (the “Subdivision Conditions”) in respect of the Subject Property;
AND THE TRIBUNAL having issued a revised order on July 26, 2024 (the “Revised Order”) approving, among other things:
(a) a substitution of parties in this matter to reflect new owners of the Subject Property;
(b) a revised Draft Plan of Subdivision (the “Revised Draft Plan of Subdivision”); and
(c) a revised set of Subdivision Conditions;
AND THE TRIBUNAL having issued a revised order on November 15, 2024 (the “Second Revised Order”) approving:
(a) a further substitution of parties in this matter to reflect new owners of the Subject Property (the “Appellants”); and
(b) an extension to the lapsing date to register the Revised Draft Plan of Subdivision from November 16, 2024 to June 15, 2025;
AND THE TRIBUNAL having been advised by the City and the Appellants that the Revised Order inadvertently attached as Attachment “1” to that order an incorrect version of the Revised Draft Plan of Subdivision;
AND THE TRIBUNAL being satisfied that this error is a minor error within the intent of Rule 24.4 of the Tribunal’s Rules of Practice and Procedure;
AND THE TRIBUNAL having received a request from the City and the Appellants for a correction to the Revised Order in order to replace the Revised Draft Plan of Subdivision set out in Attachment “1” to the Revised Order pursuant to Rule 24.4 of the Tribunal’s Rules of Practice and Procedure;
THEREFORE THE TRIBUNAL ORDERS that:
(a) The previously approved Revised Draft Plan of Subdivision as attached to the Revised Order is hereby replaced with the Revised Draft Plan of Subdivision prepared by Maja Krcmar dated November 27, 2024, attached hereto as Attachment “1”, which is hereby draft approved; and
a) All other aspects of the Revised Order and the Second Revised Order remain in force.
