THIS MATTER involving an appeal under subsections 22(7) of the Planning Act, R. S.
O. 1990, c. P. 13, as amended, regarding the failure of the Town of Oakville to make a decision within the prescribed time period on an Official Plan Amendment to redesignate the lands known as Part of Lot 12, Concession 2, North of Dundas Street in the Town of Oakville, by amending the North Oakville East Secondary Plan to facilitate a compact mixed-use community to support existing and planned transit services;
AND THE TRIBUNAL, having received and considered the affidavit and exhibits sworn and dated May 22, 2025, of Stephanie Matveeva, a member of the Canadian Institute of Planners and a Registered Professional Planner in Ontario, in the area of land use planning, filed on consent of the Parties;
AND THE TRIBUNAL, having reviewed and considered the uncontroverted affidavit evidence of Stephanie Matveeva on the nature and scope of the changes that led to the settlement proposal, including:
Permitting residential land uses in the Trafalgar Urban Core 1 Area;
Providing for public amenities through a designated Community Park Area;
Introducing a minimum density of 160 residents and jobs per gross hectare;
Identifying locations where ground-related retail and service commercial uses are to be planned for, and addressing how land use and density should be deployed across the lands;
Introducing area-specific policies that speak to the provision of a range of unit sizes;
Introducing area-specific policies that address the coordination of the proposed road network with adjacent landowners; and,
Amending Figure NOE 2 Land Use Plan of the North Oakville East Secondary Plan to add a “CP” symbol on the lands to identify the potential location of the Community Park Area and associated facilities.
AND THE TRIBUNAL, having accepted the uncontested evidence of Stephanie Matveeva, finds that the proposed settlement and revised instrument giving effect
thereto is consistent with the Provincial Planning Statement, 2024, conforms with the former policies of the Official Plan for the Region of Halton and implements the Official Plan for the Town of Oakville, including the North Oakville East Secondary Plan, in a manner that constitutes good planning for the subject area;
NOW THEREFORE:
THE TRIBUNAL ORDERS THAT;
The appeal under subsections 22(7) of the Planning Act is allowed;
The Official Plan for the Town of Oakville is amended as set out in Attachment 1
to this Order; and
- The Town of Oakville is authorized to assign a by-law number to the Official Plan Amendment at Attachment 1.
AND THE TRIBUNAL ORDERS that it may be spoken to in the event that any issues should arise in connection with the implementation of this Order.

A by-law to adopt an amendment to the North Oakville East Secondary Plan forming part of the Official Plan of the Oakville Planning,

WHEREAS the North Oakville East Secondary Plan, approved by the Ontario Municipal Board on January 11, 2008, forms part of the Official Plan of the Oakville Planning Area applicable to lands not covered by the Livable Oakville Plan;
WHEREAS subsection 21(1) of the Planning Act, R.S.O. 1990, c.P.13, as amended, states that the provisions of the Act with respect to an official plan apply, with necessary modifications, to amendments thereto and section 17 applies to any such amendment;
WHEREAS subsection 22(1) of the Planning Act provides that a person or public body may request a council to amend its official plan;
