MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON MAY 16, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference ("CMC") in the matter of an appeal by Sequoia Stockyards GP Inc. and Sequoia Stockyards LP ("Appellant"), arising from the failure of the City of Toronto ("City") to make a decision on the Official Plan Amendment, Zoning By-law Amendment and Draft Plan of Subdivision, pursuant to ss. 22(7), 34(11), 51(34) of the Planning Act and ss. 114(15) of the City of Toronto Act, for the property located at 1799 St. Clair Avenue West ("site").
2The Appellant is seeking to permit the construction of three (3) mixed-use residential towers.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
PRELIMINARY MATTER
4Prior to the CMC, the Tribunal received a Participant Status request from 2530507 Ontario Inc. (Dunpar). However, just prior to the CMC, that request was withdrawn.
STATUS REQUESTS
5In advance of the CMC, the Tribunal received one Party Status and two Participant Status requests.
PARTY STATUS REQUEST
6i2 Developments (Old Weston) Inc., the owner of the lands that abut the site from the south, requested Party Status to ensure that there is adequate tower separation between the proposed buildings located on the site and the Mixed-Use Tower, located on their property, and matters related to the access road. Mr. Cole has indicated that his client will try to resolve their issues with the Appellant prior to the Hearing. If those issues are not resolved, Mr. Cole indicated that they intend to have at least one expert witness at the Hearing.
7The Tribunal granted Party Status to i2 Developments (Old Weston) Inc.
PARTICIPANT STATUS REQUEST
8The first Participant Status request was received from Alexander Khan, the owner of 324 Old Weston Road, who is in favour of the development proposal and wants to ensure that he can maintain the laneway access to the rear of his property during and after construction.
9The second Participant Status seeker is Jared Mercer, who also supports the proposed development and requests a laneway and parking to be added between his backyard and the proposed development. Since Mr. Mercer was not present at the CMC, his request is denied.
10The Tribunal granted Participant Status to Alexander Khan.
MEDIATION
11The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
DRAFT PROCEDURAL ORDER, ISSUES LIST AND HEARING DATE
12At the onset of the CMC, the Tribunal received a copy of the Draft Procedural Order ("DPO") and Issues List ("IL"); however it was not provided on the consent of the Parties. The Parties requested that a DPO and IL be submitted after receiving instructions from the City Council following the meeting that will take place in late June.
13DPO and IL are due on or before, Friday, July 11, 2025.
14A nine-day Hearing is scheduled to proceed by video and commence on Monday, March 23, 2026, at 10 a.m. and continue through Thursday, April 2, 2026.
