MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN COOKE ON MAY 14, 2025 AND ORDER OF THE TRIBUNAL
1The matter before the Tribunal was the first Case Management Conference ("CMC") for the appeals of Cachet Developments (Woodstock) Inc. ("Appellant") pursuant to subsection 14 of the Development Charges Act, 1997, S.O. 1997, c. 27 ("Act") of Oxford County ("County") By-Law No. 6639-2024.
2The Parties informed the Tribunal that the Appellant has submitted an additional application pursuant to the Act related to County By-law 6709-2025, which has not yet been assigned a Tribunal case number. Counsel for the County explained that By-law No. 6709-2025 amends sections of By-law No. 6639-2024, and they believe it would be appropriate to consider the matters together. The Parties have requested that the two appeals be consolidated.
3The Tribunal agrees with the recommendation of the Parties to consolidate the two appeals concerning By-law 6639-2024 and By-law No. 6709-2025. Furthermore, the Tribunal directs that, due to the direct correlation between the two appeals, there is no need to conduct a CMC for the recently filed appeal of By-law No. 6709-2025.
4The Parties informed the Tribunal that preliminary discussions have occurred; however, they are currently not ready with an Issues List or a draft Procedural Order. The Tribunal was also made aware that mediation to resolve issues is being considered. The Parties requested that a written update be provided to the Tribunal no later than December 12, 2025, for further direction from the Tribunal to be considered.
ORDER
5THE TRIBUNAL ORDERS that Case No. OLT-24-00862’s appeals of Oxford County By-law No. 6639-2024 be consolidated with the filed appeals to the Tribunal of Oxford County By-law No. 6709-2025.
6The Tribunal directs that a written update for the Tribunal consideration be submitted no later than December 12, 2025.
