MEMORANDUM OF ORAL DECISION DELIVERED BY S. DEBOER ON MAY 2, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The matter before the Tribunal was a Case Management Conference (“CMC”) for the various appeals pursuant to section 17(24) and section 17(36) of the Planning Act due to the City of Brampton’s (“City”) approval of the Official Plan Amendments that propose the addition of interim Official Plan polices regarding the City’s Major Transit Station Areas.
2The purpose of the CMC was to review the status of the appeals and the next steps in the hearing process.
STATUS UPDATE
3Representing the City, Mr. Engell gave a high level a high-level review of the appeals and where the appeals stand at this moment. Mr. Engell noted that since the last hearing event, the Parties had entered Tribunal-led mediation. The results of the mediation are awaiting further instructions from the City’s council. It was Mr. Engell’s intent to have the City’s instructions before the Tribunal today pertaining to “without prejudice” settlements with some of the Parties. However, due to the lack of instructions, Mr. Engell is not able to provide the requests for written settlement hearings concerning these potential settlements. When he does receive these instructions, he may request that written settlement hearings be requested and heard by the Tribunal. All the Parties agreed with Mr. Engell’s comments pertaining to the potential settlements that are before City council. The Tribunal ruled that once these instructions have been received, then the City can request that written settlement hearings be scheduled in the Tribunal’s calendar.
PARTY REQUEST
4Mr. Engell stated that the Party request submitted by Brampton Plan should be deferred to the next CMC as there are decisions that are needing to be issued by the Tribunal that may affect the status of this Party request. Ms. Benedetti, who represents Brampton Plan, agreed with Mr. Engell’s statement that the Party request should be deferred to the next hearing event. The Tribunal ruled that this was appropriate, and the Party status would be dealt with at the next hearing event.
5It was Mr. Engell’s request that a further CMC be scheduled for the Fall of 2025. By this time, a draft Procedural Order should be more succinct as the number of appellants should be less and some of the appeals should be resolved by that time.

6The Tribunal has scheduled a further CMC which will proceed by video Thursday, October 9, 2025, at 10 a.m.
