1On May 15, 2025, the Tribunal convened a status update telephone conference call regarding this proceeding. The proceeding relates to an appeal brought by McArthur Island Inc., McArthur Square Development Inc., and 2668775 Ontario Inc. (“Appellants”) regarding the extension of Interim Control By-law No. 83-2024 by the Town of Carleton Place and whether the Appellant’s property located at 150 Mill Street should be subject to it.
2At the status update call, the Parties informed the Tribunal that they have reached a proposed settlement and they requested that the proposed settlement be considered by the Tribunal by means of written settlement hearing.
3The Tribunal raised a concern regarding whether proper notice of this hearing event had been served. Ms. Bratton, representing the Appellants, very ably reviewed the steps that had been taken and demonstrated that notice has been properly served. To ensure efficiency and an expeditious conclusion to the proceeding, she thoughtfully suggested that an updated Affidavit of Service could be executed and filed with the Tribunal. The Tribunal agreed with this pathway forward.
4Subsequent to the status update call, the Appellants filed an updated Affidavit of Service with the Tribunal.
5The Tribunal has scheduled a written hearing at which the proposed settlement will be considered on Tuesday, May 20, 2025. The materials in support of the proposed settlement along with a draft Order have already been filed with the Tribunal.
