MEMORANDUM OF ORAL DECISION DELIVERED BY a. sauve ON APRIL 30 2025 AND ORDER OF THE TRIBUNAL
1This was the first hearing event for this matter. The City had failed to make a decision regarding these Applications requesting an Official Plan Amendment and a Zoning By-law Amendment regarding 126, 136 and 140 Bradford Street (“Subject Lands”) within the specified time period. The City informed the Tribunal that they do not support the Applications in their current form.
2The Appellant filed the Applications to facilitate the development of the Subject Lands with a mixed-use building, composed of two residential towers, each 45 storeys in height, connected by a shared six-storey podium with commercial uses at grade. The Subject Lands have an approximate area of 0.39 hectares with 89.9 metres of frontage along Bradford Street and are located approximately 360 metres east of the shoreline of Lake Simcoe.
3The Tribunal received an Affidavit of Service for this matter and marked it as Exhibit 1.
4The Parties had submitted a draft Procedural Order (“PO”), however they had not finalized an Issues List and asked for the Tribunal to schedule a second Case Management Conference (“CMC”) in order to complete the PO, Issues List, set hearing dates, and to hear the Participant Status request discussed below.
5The availability of Tribunal led mediation was explained to the Parties.
6The Tribunal had not received any Party or Participant Status requests prior to the Case Management Conference, however, Mr. Gary Bell attended the hearing and expressed interest in becoming a Participant. Mr. Bell informed the Tribunal that he is a resident and a planner. The Tribunal directed that Mr. Bell have until Friday, May 9, 2025, to submit the Participant request form and his request can be considered at the next CMC.
7The Tribunal directs as follows:
a. Mr. Bell is to submit a Participant Status request by Friday, May 9, 2025; and
b. A second CMC will be heard at 10 a.m. on Tuesday, May 27, 2025, by Video.
8Parties are asked to log into the video hearing at least 15 minutes before the start of the event to test their video and audio connections.
