UPON APPEALS having been brought by Sheppard Lamont Limited Partnership (“Appellant”) under subsection 22(7) and 34(11) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, regarding the refusal by the City of Toronto (“City”) to approve applications for an Official Plan Amendment and a Zoning By-law Amendment which seek to facilitate the redevelopment of a 46-storey mixed-use building comprising 726 residential units on the lands municipally known as 4151-4155 Sheppard Avenue East, in the City of Toronto (“Subject Lands”);
AND THIS MATTER having been set down for a seven-day Merit Hearing initially scheduled to commence on Tuesday, April 22, 2025, which was adjourned as a result of a tentative settlement reached between the Parties;
AND THIS MATTER having come before the Tribunal on Monday, April 28, 2025, by videoconference for a Case Management Conference (“CMC”) in order to provide an update as to the status of the proceedings;
AND THE TRIBUNAL, having been advised that a City Council meeting had taken place on Wednesday, April 23, 2025, wherein a without prejudice settlement offer was considered and adopted by City Council;
AND THE TRIBUNAL, having been further advised that a resolution had been passed by City Council on the morning of Monday, April 28, 2025, approving the settlement reached and that the Parties required further time to prepare the necessary materials to present the settlement before the Tribunal for a hearing on the merits;
AND THE TRIBUNAL, having scheduled a Merit Hearing returnable Thursday, May 22, 2025, to be heard in writing for the purposes of considering the merits of the settlement reached;
THE TRIBUNAL ORDERS THAT:
A Merit Hearing is scheduled to commence on Thursday, May 22, 2025 to be heard in writing.
