MEMORANDUM OF ORAL DECISION DELIVERED BY SHARON L. DIONNE ON APRIL 30, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the Tribunal’s Decision and Order stemming from a first Case Management Conference (“CMC”) on the appeals of the Applicant/Appellant, in respect of the decision of the Council of the City of Toronto to refuse planning applications for amendments to the City’s Official Plan and Zoning By-law to permit a 40-storey mixed use building containing 536 residential dwelling units. The affected lands are municipally known as 4696 Yonge Street, Toronto (“Subject Property”).
2The Tribunal received an Affidavit of Service, sworn on April 14, 2025, confirming that proper notice of this CMC was given, and marked same as Exhibit 1.
REQUESTS FOR STATUS
3The Tribunal received a request for Participant status from Jennifer Winter Di Cola of Florence Avenue, Toronto, and accepted the Participant Statement on consent of the Parties.
4Additionally, Jeff Oulahen expressed, on behalf of the Owner of lands across the street from the Subject Property, an interest in the matters before the Tribunal. However, prior to the CMC, he had not submitted a formal request for status. The Tribunal advised that should Mr. Oulahen decide to make a formal request for status, that it is done so by no later than Friday, May 2, 2025, and that such a request would be dealt with in due course.
PROCEDURAL MATTERS
5The Parties submitted a draft Procedural Order (“PO”) in advance of the CMC.
6The Tribunal was advised that the Parties have been engaged in without prejudice discussions, to find some resolution to, and scoping of, the issues between them, and that such discussions are on-going.
7The Parties agreed on procedural matters and were seeking the scheduling of a two-week hearing to be held no earlier than in late November 2025. This timing should allow for further discussions and potentially further scoping of the issues between them.
8It is noted that should the Parties have an interest, there are opportunities for Tribunal-led mediation available.
9The Tribunal inquired as to whether there were any other matters to be addressed, and the Parties indicated there were none.
NEXT STEPS
10A hearing is scheduled for a period of nine-days, commencing on Tuesday, November 18, 2025, at 10 a.m. by video conference.
11The Tribunal directs the Parties to finalize the PO to align with the date set for the Hearing, and to submit same by no later than 4:30 p.m. on Friday, June 6, 2025, for the Tribunal’s review and approval.

ORDER
15THE TRIBUNAL ORDERS THAT:
a. Jennifer Winter Di Cola is granted Participant status;
b. A hearing is scheduled as described above in this Decision; and,
c. The Parties shall deliver a draft Procedural Order to the Tribunal on or before Friday, June 6, 2025, in agreed form and content or, failing such agreement, with any areas of disagreement clearly delineated.
