INTRODUCTION
1This Decision and Order arises from a Hearing on the Merits regarding appeals filed by Tricar Properties Ltd. (“Appellant”) pursuant to ss. 22(7), 34(11) and 41(12) of the Planning Act, R.S.O. 1990, c. P.13, as amended (“Act”), concerning official plan amendment, zoning by-law amendment, and site plan approval applications (together, “Applications”) in the City of Guelph (“City”).
2The Applications seek to permit the development of two 12-storey apartment buildings on lands known municipally as 1242-1270 Gordon Street and 9 Valley Road (“Subject Lands”).
3The City did not make a decision on the Applications within the statutory timeframes prescribed by the Act and the appeals were filed on that basis.
SETTLEMENT
4Following an iterative planning process involving several resubmissions of the Applications, the Parties reached a settlement of the appeals and executed Minutes of Settlement on March 25, 2025 (“Settlement”), which were marked as Exhibit 2.
