MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON APRIL 29, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of an appeal by Pheasant Run Realty Holdings Inc. (“Appellant”) arising from the failure of the Town of The Blue Mountains (“Town”) to make a decision on the Zoning By-law Amendment Application, pursuant to ss. 34(19) of the Planning Act, for the property located at 24 Alfred Street West.
2The Appellant is seeking to facilitate the development of 19 new residential units.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
4The Tribunal did not receive any status request in advance of this CMC.
MEDIATION
5The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
DRAFT PROCEDURAL ORDER, ISSUES LIST AND HEARING DATE
6At the CMC, Mr. Vernon informed the Tribunal that the Parties did not provide a draft Procedural Order (“PO”) and Issues List (“IL”) in advance of the CMC, because the matter will go before the Town Council next month to see if any of the issues could be resolved prior to the Hearing.
7The Tribunal directed the Parties to provide a draft PO and IL on or before Thursday, May 29, 2025.
8At the CMC, Parties requested a five-day Hearing to be scheduled in the last two weeks of October 2025. If the number of days can be reduced, the Tribunal directed the Parties to inform the assigned Case Coordinator.
9A five-day Hearing is scheduled to proceed by video and commence on Monday, October 20, 2025, at 10 a.m. and continue through Friday, October 24, 2025.
10Parties are asked to log into the Video Hearing at least 15 minutes before the start of the event to test their video and audio connections:

Questions prior to the Hearing event may be directed to the Tribunal’s Case Coordinator having carriage of this case.
