MEMBER

THIS MATTER having come before the Tribunal by way of written hearing;
AND THE TRIBUNAL having been advised by all Parties to this matter that the Parties have agreed upon a revised site plan application (“Revised SPA”) for the lands known municipally as 700 and 750 Winston Churchill Boulevard (formerly 772 Winston Churchill Boulevard) in the Town of Oakville (“Town”);
AND THE TRIBUNAL being in receipt of and having reviewed and considered the uncontested opinion evidence contained in the affidavit of Scott Arbuckle, affirmed on March 31, 2025;
AND THE TRIBUNAL hereby recognising Mr. Arbuckle, a Registered Professional Planner having 35 years of professional land use planning experience, as being qualified to provide the Tribunal with expert opinion evidence in the area of land use planning;
AND THE TRIBUNAL recognising that Exhibit 3 and Exhibit 4 to the affidavit of Mr. Arbuckle contain the Revised SPA (contained in Attachment 1 to this Order) and Conditions of Site Plan Approval, respectively, that reflect the outcome of settlement discussions between the Parties;
AND WHEREAS Mr. Arbuckle’s affidavit confirms for the Tribunal that the Revised SPA:
Has regard for the matters of provincial interest as set out in s. 2 of the Planning Act, R.S.O. 1990, c. P.13, as amended;
Is consistent with the Provincial Planning Statement, 2024;
Conforms to the Region of Halton Official Plan;
Conforms to the Town Official Plan;
Conforms to the Town Zoning By-law;
Has appropriate regard for the Ministry of Environment, Conservation and Park’s D-6 Compatibility Guidelines, 1995, regarding the proximity of industrial facilities to sensitive land uses;
Represents good planning; and
Is in the public interest;
AND WHEREAS Mr. Arbuckle’s affidavit, at Paragraph 128, confirms for the Tribunal that all conditions of site plan approval have been cleared by the Town, the Region of Halton, the Region of Peel, and the Credit Valley Conservation Authority;
AND WHEREAS Mr. Arbuckle’s affidavit further confirms for the Tribunal that a site plan agreement has been executed between the Parties;
THE TRIBUNAL ORDERS that:
The appeal by 772 Winston Churchill Limited Partnership pursuant to s. 41(12) of the Planning Act is allowed, in part; and
The site plan prepared by Baldassarra Architects Inc., dated November 15, 2024, and the associated plans and drawings, as set out in Attachment 1 to this Order, are approved.
