MEMORANDUM OF ORAL DECISION DELIVERED BY S. TOUSAW ON APRIL 10, 2025 AND ORDER OF THE TRIBUNAL
Introduction
1This first Case Management Conference (“CMC”) was convened for the appeals of 1956565 Ontario Inc. (“Applicant”/“Appellant”) to the absence of decisions by the City of Toronto (“City”) for Official Plan Amendment (“OPA”) and Zoning By-law Amendment (“ZBA”) applications affecting lands at 120 Bouchette Street, Toronto (“site”).
2The Applicant’s Affidavit of Service for Notice of this CMC was marked as Exhibit 1. No further Notice is required for subsequent proceedings for these appeals.
Parties and Participants
3The statutory Parties are the Applicant and the City.
4With no objection from the Applicant and the City, the Tribunal granted Party status to the sole requestor, the Toronto Port Authority (“Ports Toronto”). Ports Toronto’s operations include the Billy Bishop Toronto City Airport located on Toronto Island, a few kilometres to the west of the site. The site is located below certain flight paths to/from the airport. Ports Toronto anticipates no issues with the tower heights proposed for this site but wishes to remain involved should the proposal change.
5No requests for Participant status were received.
Next Steps
6The Parties anticipate pursuing mediation and are aware that Tribunal-led mediation is available at their request.
7The Parties will file a Procedural Order on consent by July 1, 2025 for the consideration of approval from the Tribunal by separate Order.
8Should the Parties reach a settlement on their identified issues, they may request the scheduling of a Settlement Hearing to be held in writing or by Video Hearing.
9At the Parties’ request, a nine-day Merit Hearing is scheduled to commence at 10 a.m. on January 19, 2026 and conclude on or before January 30, 2026, by Video Hearing (not sitting on January 26, 2026).
