UPON APPEALS having been brought by Wycliffe Royal York Limited (“Appellant”) under subsection 22(7) and 34(11) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, regarding the failure by the City of Toronto (“City”) to make decisions within the prescribed time period in respect of applications for an Official Plan Amendment and a Zoning By-Law Amendment, respectively, which seek to facilitate the development of a twelve-storey apartment building on the lands municipally known as 464 Royal York Road, in the City of Toronto (“Subject Lands”);
AND THIS MATTER having come before the Tribunal on Friday, April 11, 2025, by videoconference for a first Case Management Conference (“CMC”), whereby it marked as Exhibit 1 the Affidavit of Service of Marie Wakefield sworn on February 20, 2025, attesting to proper Notice having been given for this first CMC;
AND THE TRIBUNAL, having received one request for Party status from 693380 Ontario Limited, the abutting landowner to the south of the Subject Lands with a direct interest in the proceedings, and who confirmed its participation during the Municipal planning process leading to the present Appeals;
AND THE TRIBUNAL, having considered the submissions made on behalf of the proposed Non-Appellant Party, there being no objections made by either of the Statutory Parties, found that there are reasonable grounds for the request and thereby granted Party status to 693380 Ontario Limited (“Added Party”);
AND THE TRIBUNAL having confirmed the Parties’ intention to participate in Tribunal-led mediation;
AND THE TRIBUNAL having considered the draft Procedural Order (“PO”) submitted on consent, inclusive of draft Issues List (“IL”), confirmed with the Parties of their intention to call a total of between nine-ten witnesses at the Merit Hearing comprised of up to four experts anticipated by the Appellant, up to five experts anticipated by the City, and one expert anticipated by the Added Party;
AND THE TRIBUNAL having directed that a final PO, inclusive of a final IL identifying any issues the Added Party wishes to add, is due to be filed no later than Tuesday, April 22, 2025;
AND THE TRIBUNAL having scheduled a ten-day Merit Hearing to commence on Monday, February 2, 2026, through to and including Friday, February 13, 2026, by videoconference with the following log-in credentials:
