THIS MATTER regarding SLH Lakeshore Inc.’s appeal of its Official Plan Amendment application (“OPA Appeal”);
AND THE TRIBUNAL having received a request from the Applicant to consolidate its OPA Appeal with its ongoing Zoning By-law Amendment and Site Plan Control Appeals (the “ZBA/SPA Appeals”) assigned Case Numbers OLT-23-000697 & OLT-23-000698, respectively, so that they can be heard by the Tribunal together;
AND THE TRIBUNAL having considered written submissions from the Applicant dated March 14, 2025, that outline the reasons underlying the consolidation request, and upon being advised that the other Parties to the ZBA/SPA Appeals have provided written consent to the consolidation request, and having considered the provisions of Rule 16 of the Tribunal’s Rules of Practice and Procedure;
NOW THEREFORE
THE TRIBUNAL ORDERS THAT:
The OPA Appeal is hereby consolidated with the ZBA/SPA Appeals in accordance with Rule 16.1 of the Tribunal’s Rules of Practice and Procedure (the “Rules”);
Per Rule 16.2 of the Rules, the Parties to the ZBA/SPA Appeals are Parties to the OPA Appeal;
The consolidated proceeding will be heard at the eight-day hearing event already scheduled for the ZBA/SPA Appeals, which is scheduled to commence at 10:00 a.m. on Monday, May 26, 2025;
The Parties shall prepare and finalize a revised draft Procedural Order for the Tribunal’s approval by Friday, March 21, 2025;
The Applicant shall give the Notice of Hearing for the consolidated proceeding in accordance with the Direction Letter to be provided by the Tribunal Case Coordinator;
The SPA Appeal is adjourned sine die.
