MEMORANDUM OF ORAL DECISION DELIVERED BY HUGH S. WILKINS ON MARCH 28, 2025 AND ORDER OF THE TRIBUNAL
1On March 28, 2025, the Tribunal held a status update telephone conference call (“TCC”) in these proceedings. The proceedings consist of appeals filed by CSG Yonge Manor Limited and CSG Hillsdale Limited (“Appellants”) arising from the refusal by the City of Toronto (“City”) of official plan and zoning by-law amendment applications filed by the Appellants regarding a proposed mixed-use development at 2079-2111 Yonge Street, 9-11, 21 and 31 Hillsdale Avenue East, and 12-18 Manor Road East.
2On November 25, 2024, the Tribunal held a Case Management Conference at which it approved a Procedural Order, which included a due date of February 28, 2025 for the exchange of witness statements. At the CMC, the hearing of the appeals was scheduled to commence on Monday, April 28, 2025. Five days were set aside for the hearing.
3At the status update TCC, the Appellant stated that the Parties, without direction or an Order from the Tribunal, agreed to delay the exchange of the witness statements until March 17, 2025. It stated that the Added Party, Amskor Corporation (“Amskor”), failed to provide its witness statement by that date. The Appellant submitted that it is being hindered from properly preparing for the hearing due to Amskor’s failure to produce its witness statement(s). It requested that Amskor be removed as a Party or alternatively that its status be changed to Participant status.
4The City supported the Appellant’s request.
5Amskor responded by stating that there was a death in the family of Amskor’s owner, which has delayed its preparation of its witness statement(s). Amskor submitted that it has retained a land use planner and requested that the due date for production of its witness statement(s) be extended.
6Given the personal circumstances facing Amskor’s owner and the timing of the hearing, the Tribunal found that it is both fair and practical to extend the due date for the production of Amskor’s witness statement(s). The Tribunal directed that the due date for Amskor to produce its witness statement(s) is extended to Friday, April 4, 2025 and the due date for the production of reply witness statements is extended to Friday, April 11, 2025.
7The Tribunal encouraged the Parties to continue their efforts to resolve the appeal through settlement discussions.
ORDER
8THE TRIBUNAL DIRECTS that the due date for Amskor Corporation to produce its witness statement(s) is extended to Friday, April 4, 2025 and the due date for the production of reply witness statements is extended to Friday, April 11, 2025.
