MEMORANDUM OF ORAL DECISION DELIVERED BY KURTIS SMITH ON March 25, 2025 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened the first Case Management Conference (“CMC”) pertaining to the three appeals filed against the County of Brant (“County”) Development Charges By-law No. 109-24, under section 14 of the Development Charges Act, 1997, S.O. 1997, c. 27.
2The three Appellants are:
- Losani Homes (1998) Ltd.
- Paris Grand Estates Inc.
- Sifton Properties Limited
3The grounds for the Appellants’ appeals are generally the methodology used to calculate the Development Charges relating to population, employment, and servicing needs, for example highways, water, wastewater, and stormwater management.
4No Party or Participant status requests were received.
SECOND CASE MANAGEMENT CONFERENCE
5Prior to the commencement of the CMC, the Tribunal received a timeline/schedule agreed upon by all Parties to advance the case leading up to a requested second CMC in late June.
6The Parties agreed to the following timeline:
- Appellants will provide their preliminary Issues List (“IL”) to the County by Friday, April 11, 2025;
- Appellants may submit written interrogatories to the County on matters that are relevant to those issues by Friday, May 2, 2025;
- The County will respond to the written interrogatories by Friday, May 30, 2025;
- If a hearing is required, the Appellants or remaining Appellants will provide their final IL prior to the second CMC but no later than Friday, June 20, 2025.
7The Tribunal directed the Parties to submit the draft Procedural Order to the Case Coordinator on or before Friday, June 20, 2025, for review and consideration at the second CMC.
8The Tribunal scheduled the second CMC to commence at 10 a.m. on Wednesday, June 25, 2025, by Video Hearing.

ORDER
13THE TRIBUNAL ORDERS as follows:
- The draft Procedural Order and Issues List is to be submitted to the Case Coordinator on or before Friday, June 20, 2025;
- A second Case Management Conference is scheduled for Wednesday, June 25, 2024, at 10 a.m. by Video Hearing as set out above; and
- The Member is not seized.
