THESE MATTERS having come to the Ontario Land Tribunal at the request of Canadian Tire Real Estate Limited, on consent of all Parties, to correct technical errors in the instruments and that the Tribunal finds that the request meets all applicable statutory tests under the Planning Act, R.S.O. 1990, c. P.13, as amended, and represents good planning and is in the public interest;
THE TRIBUNAL ORDERS that:
Canadian Tire Real Estate Limited is granted Party Status.
The appeals are allowed, in part, as follows:
a. Site and Area-Specific Policy 357 is amended by replacing the mapping with Attachment 1.
b. City of Toronto By-law 1170-2011 is amended by replacing Schedules 1, 2, and 3 with the updated mapping included in Attachment 2.
c. Section 3(xvi) of City of Toronto By-law 1170-2011 is deleted in its entirety.
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to should a matter arise in connection with the implementation of this Order.
