MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON MARCH 12, 2025 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of an appeal by 11 Pleasant Boulevard East Limited (“Applicant” / “Appellant”) arising from the failure of the City of Toronto (“City”) to make a decision on the Zoning By-law Amendment (“ZBA”), pursuant to ss. 34(11) of the Planning Act (“Act”), for the property located at 11 Pleasant Boulevard.
2The Applicant is seeking to permit the development of a 17-storey residential building with a total height of 62.75 metres at a corner lot at Yonge Street and Pleasant Boulevard.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
4The Tribunal did not receive any status request in advance of this CMC.
MEDIATION
5The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, to reach out to the assigned Case Coordinator.
DRAFT PROCEDURAL ORDER, ISSUES LIST AND SECOND CMC
6Prior to the CMC, Mr. Bronskill informed the Tribunal that the Parties did not provide a draft Proceedural Order (“PO”) and Issues List (“IL”) in advance of the CMC because City staff will be seeking instructions from City Council at its meeting commencing on May 21, 2025.
7The Tribunal directed the Parties to provide a draft PO and IL on or before, Friday, May 30, 2025.
8A second CMC is scheduled to commence on Monday, June 9, 2025 at 10 a.m.
