INTRODUCTION AND BACKGROUND
1This matter involves a settlement hearing related to appeals filed by Windfield Estates Corporation (“Appellant”) pursuant to ss. 22(7) and 34(11) of the Planning Act (“Act”) and s. 114(15) of the City of Toronto Act against the failure of the City of Toronto (“City”) to make decisions within the statutory time frame regarding the Appellant’s Official Plan Amendment (“OPA”) and Zoning By-law Amendment (“ZBA”) applications (collectively “Applications”), and a related Site Plan Control (“SPC”) application, for the lands municipally known as 390-400 Woodsworth Road (“Property”).
2The purpose of the Applications, as filed, was to facilitate the redevelopment of the Property with three mid-rise buildings along Leslie Street and four-storey stacked back-to-back townhouses along Woodsworth Road.
